Conditional Use Denial Reversed on Appeal

April 17, 2014   A conditional use application denied in September 2013 was reversed today by the Lycoming County Court of Common Pleas.   Salzmann Hughes, PC client Centura Development Co., Inc., had applied for conditional use approval to operate a water withdrawal and water distribution facility on its property in Old Lycoming Township.   After six hearings, the Township denied the conditional use application and Centura appealed.   On April 17, 2014, the Court reversed the Township and approved the conditional use application.   Centura was represented during the conditional use hearings by Attorney Kurt E. Williams and on appeal by Attorneys Scott T. Wyland and Kurt E. Williams.

On May 17, 2017, the Lebanon County Court of Common Pleas reversed a decision of the City of Lebanon Zoning Hearing Board (the “ZHB”) to uphold the denial of a zoning permit to Salzmann Hughes, PC client Pennsylvania Counseling Services (“PCS”). The denial of the permit prevented PCS from opening a Day Reporting Center (“DRC”) within the City’s Central Business District, which PCS plans to operate under contract from Lebanon County. The Court reversed the ZHB and granted PCS’s appeal allowing the DRC to open. PCS was represented before the ZHB and during the appeal by Salzmann Hughes, PC attorneys Kurt E. Williams, Esq. and Scott T. Wyland, Esq.
